In an earlier post on the subject of lot size averaging I discussed the implications of a last minute change made by the outgoing Council to the draft Palerang Local Environmental Plan (PLEP).
After a minor procedural hiccup, the new Council has succeeded in reversing this particular amendment, effectively leaving rural subdivision arrangements as they currently stand until any change can be justified through an appropriate Rural Settlement Study.
This basically means that, under the new PLEP, lot size averaging provisions will remain as they currently are and apply only to areas where the minimum lot size is 80ha. The relevant provisions have been transcribed directly from the Yarrowlumla Local Environmental Plan 2002 into the draft Palerang Local Environmental Plan 2012. Lot size averaging provisions will not be extended into areas with a smaller minimum lot size.
The amended draft PLEP has now been certified by the NSW Department of Planning & Infrastructure and will go on public exhibition on 5 December 2012. I will discuss the PLEP exhibition process in a separate Palerang Blog entry.
